Southwest Airlines – “Any kind of Hemp or CBD Oil, whether from Hemp or Marijuana, is not accepted under any circumstances at this time,” stated the Supervisor from Southwest Airlines.

Alaska Airlines – The Supervisor told me that any kind of CBD Oil is not accepted by Alaska Airlines.

When I asked the Airline Supervisors about bringing Capsule or Topical Hemp Oil on an airplane, each Airline stated those are also not allowed for National or International Travel.

What is CBD?

In the first half of 2019 there were a few cases in the news that sparked concern about the legality of flying with CBD. In one, a 71- year old woman was arrested at Dallas-Fort Worth International Airport for traveling with CBD oil she claimed helped with her arthritis pain.

 The 2018 Farm Bill Made CBD Legal in all 50 States – But Not Without Major Confusion

Hemp and hemp-derived CBD have long been grouped together with marijuana and, as such,  listed as a Schedule I Controlled Substance — making it illegal on the Federal level to grow, process, or possess hemp.

An attempt to modify this rule in a 2014 version of the Farm Bill resulted in even more confusion, so in 2018 Congress passed a Federal bill, the 2018 Farm Bill (more formally known as the Agricultural Improvement Act). After being signed by President Trump, it was clear that two major shifts have occurred in how the federal government thinks of Hemp.

1.) First, Hemp no longer appears in the definition of Marijuana in section 102(16) of the Controlled Substances Act, 21 U.S.C. § 802(16).

2.) Second, the 2018 Farm Bill created an exception for Tetrahydrocannabinols (THC) in hemp in the Controlled Substances Act, 21 U.S.C. § 812(c) regarding the listing of THC as a Schedule I controlled substance. The THC exception allows for up to 0.3 percent THC to be present in Hemp-based CBD products, opening the door for the plethora of products we see on the market today.

What all of this means is that, finally, Hemp-derived CBD is legal on the federal level, with one big caveat — individual state governments retain the right to regulate it as they, and/or their constituents wish. Idaho, for one, has a very strict marijuana policy — considering a product with ANY trace of THC to be a controlled substance.

If CBD is Legal in All 50 States, Why Can’t I Bring CBD Oil on an Airplane?

This brings us back to the big question: if CBD is legal in the states I am traveling between, why is it illegal if I bring it on an airplane?

The answer – CBD may be legal on a state level, it is still illegal on a Federal Level; making it not acceptable to be carried on an airplane.

As of May 2019, the Transportation Security Administration (TSA) has updated its rules regarding “medical marijuana” products and airplanes.

According to the TSA Official Website, “possession of marijuana and cannabis infused products, such as cannabidiol (CBD) oil, is illegal under federal law except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by the FDA.”

Dry Weight Basis, defined as, “zero percent moisture” means CBD Oil is not allowed to be carried on an airplane. The TSA also states “TSA’s screening procedures are focused on security. Accordingly, TSA security officers do not search for marijuana or other illegal drugs, but if any illegal substance is discovered during security screening, TSA will refer the matter to a law enforcement officer.” Basically, the job of a TSA agent is not to search your luggage for CBD oil but if they find something they deem questionable, they will turn you and the product over to the police.

Airline Policy Restricts CBD Oil on an Airplane

What about airline policy? Shouldn’t they allow passengers to travel with the medication they need, just as they do with any other medication? We looked at the major airlines and at least here the answer is clear: no. The reason is because CBD is still illegal on the Federal Level.

According to the American Airlines restricted items list, the answer is no, saying that since the TSA prohibits marijuana, including for medical uses, they do not allow it.  “Accordingly, American does not allow passenger to transport marijuana on our flights. Anyone traveling with or transporting marijuana on American flights does at their own risk.” There is no stated exception for flights within states where medical or recreational use is legal.

Delta uses the exact same wording as American, so does Alaska Airlines. United Airlines’ “Contract of Carriage” does not seem to address the issue at all. Southwest simply refers passengers to the TSA website when it comes to their medication section, not specifically mentioning marijuana at all. This statement implies that they will allow what the TSA will allow, inducing hemp-derived CBD, but, like many aspects of this question, is not completely clear.

To clarify, I called each airline and received the same answer – CBD Hemp Oil on an airplane is not allowed either in Tincture, Topical or Capsule Form. What about international travel to a country where there are medical or recreational marijuana laws? Although there are tons of anecdotal stories about people traveling with CBD and having zero trouble, when you consider the fact that flights may be routed through states or countries where they still possess draconian drug laws, it may not be worth the risk.
